N.Y. Jury Awards $2 Million in Case Involving Raw Asbestos

NIAGARA FALLS, N.Y. -- A New York jury has awarded a former plastic worker $2 million, concluding that his mesothelioma was in fact caused by exposure to raw asbestos he mixed while making plastic molding compounds. Failing v. Asbestos Corp., Ltd., et al., No. 142698 (N.Y. Sup. Ct., 8th Jud. Dist., Niagara Cty.).
The New York Supreme Court for the 8th Judicial District, Niagara County, jury reached the verdict on Dec. 7. Hedman Resources Ltd. was the lone remaining defendant at the time of the verdict, sources said.
Judge John P. Lane (ret.) presided over the two-week trial.
