Calif. Appeal Court Upholds Grant of Nonsuit to Premises Defendant

LOS ANGELES -- A California appellate court has upheld a grant of nonsuit to a premises defendant, finding that the plaintiff had failed to prove that his father had been exposed to asbestos at the refinery in question. Webster, et al. v. ExxonMobil Oil Corp., et al., No. B227387 (Calif. 2nd Dist. Ct. App., Div. 4).

In the Nov. 28 ruling, the California 2nd District Court of Appeal found that if there is "no evidence of exposure, there is no evidence of causation," and, therefore, the trial court correctly granted ExxonMobil's motion for nonsuit.
