WASHINGTON, D.C. -- A Veterans Claims' appellate court has remanded the claims of a U.S. Army Veteran who says that fibrotic scarring of his right lung was caused by service-related exposure to asbestos. Green v. Shinseki, No. 10-0098 (U.S. Ct. App., Veterans Claims).
In the Nov. 8 decision, the U.S. Court of Appeals for Veterans Claims said that the Board of Veterans' Appeals failed to consider Johnny Green's testimony that his lung impairment could have been caused by exposure to asbestos.
