WEST PALM BEACH, Fla. -- A Florida appellate court has reversed dismissal orders in 30 asbestos cases in light of the Florida Supreme Court's recent decision that found the state's Asbestos Silica and Compensation Fairness Act was unconstitutional when applied retroactively. Witkiewicz, et al. v. ACandS Inc., et al., No. 4D08-1170 (Fla. 4th Dist. Ct. App.).
The Oct. 19 decision from the Florida 4th District Court of Appeal noted that the plaintiffs' motions to quash the lower court orders were not opposed by the defendants.
