Wash. Court Says Trial Court Erred in Interpretation of Grammatical Rules

SEATTLE -- A Washington appellate court has reversed an award of summary judgment, ruling that the trial court's reliance on grammatical rules did not support its interpretation of a disclaimer in the asbestos lawsuit. Abbay, et al. v. Aurora Pump Co., et al., No. 62399-1-I (Wash. Ct. App., Div. 1).
In the August 8 opinion, the Washington Court of Appeals, Division One, further found that the plaintiffs should have been afforded the opportunity to clarify a disclaimer in the lawsuit that was included in order to avoid removal to federal court.
