N.J. Court Affirms Award of Litigation Costs and Attorneys' Fees for Plaintiff

TRENTON, N.J. -- A New Jersey appellate court has affirmed an award of litigation costs and attorneys fees that were determined by a trial court to have been compelled by a defendant's non-acceptance of a settlement offer. Buttitta, et al. v. Allied-Signal Inc., et al., No. A-6117-09T4 (N.J. Super. Ct., App. Div.).

In the July 28 ruling, the Appellate Division of the New Jersey Superior Court found that the trial court correctly found that Asbestos Corporation Ltd. was liable for the plaintiff's costs and reasonable litigation expenses that followed the defendant's rejection of a $10 million settlement offer.
