PHILADELPHIA - The federal Asbestos MDL judge has upheld a ruling that recommended dismissal of an Alabama man's mesothelioma case against several defendants based on a last-exposure, one-year statute of limitations. Corley, et al. v. Long-Lewis Inc., et al., No. 10-61113 (E.D. Pa.).
Judge Eduardo C. Robreno said July 25 that claims based on plaintiff Charles Corley's exposure to asbestos prior to 1979 are time-barred and not subject to a revised Alabama statute that created a discovery rule specifically for asbestos claims.
