SAN FRANCISCO -- A California federal court has remanded a secondhand exposure asbestos complaint, ruling that the lawsuit was not removed in a timely manner. Savelesky v. Allied Packing and Supply Inc., et al., No. 11-01778 (N.D. Calif.).
In the July 1 opinion, the U.S. District Court for the Northern District of California found that the plaintiff's response to an interrogatory more than 30 days prior to the removal put the defendant on sufficient notice that the case could be removed to federal court.
