N.Y. Court Remands Lung Cancer Action, Says Removal Was Untimely

NEW YORK –– A New York federal court has remanded an asbestos action after finding that the removal of the lung cancer case was untimely. Levy, et al. v. A.O.Smith Water Products Co., et al., No. 12-5152 (S.D. N.Y.).
In the July 13 opinion and order, the U.S. District Court for the Southern District of New York found that the defendant had sufficient notice in April that its valves present on U.S. Naval ships were among the products that allegedly harmed the plaintiff.
