Pa. Court Upholds Summary Judgment Award to General Electric

PHILADELPHIA -- A Pennsylvania appellate court has upheld an award of summary judgment to General Electric in an asbestos case, opining that the trial court was correct in granting the motion, which was brought on statute of repose grounds. Rabatin, et al. v. Allied Glove Corp., et al., No. 2011 PA Super 118 (Pa. Super. Ct.).

In the June 3 opinion, the Pennsylvania Superior Court additionally rejected the plaintiff's contention that statute of repose did not protect the asbestos-containing component parts contained in the turbines, concluding that the plaintiff had not established that the defendant manufactured those parts.
