Texas Court Denies Writ of Mandamus Petition; Says Interlocutory Appeal Proper Remedy

HOUSTON -- A Texas appellate court has denied a petition for writ of mandamus on the ground that an interlocutory appeal is appropriate when appealing rulings relating to Texas' requirement of asbestos exposure reports. In re: The Kansas City Southern Railway Co., No. 14-11-00336-CV (Texas 14th Ct. App.).

In the April 28 decision, the Texas 14th Court of Appeals said that if the asbestos defendant wishes to appeal a decision denying its challenges to the plaintiffs' medical reports, an interlocutory appeal is the proper remedy.
