NEW YORK -- A New York Appellate court has dismissed an appeal in a workers' compensation action, finding that the issues were not ripe for review. Dow v. Silver Construction, et al., No. 510919 (N.Y. Sup. Ct., App. Div., 3rd Jud. Dept.).
In the April 14 decision, the New York 3rd Judicial Department of the Appellate Division in the Supreme Court found that reviewing the issue of an employer-employee relationship would invite an untimely review of other issues in the case.
