Mass. Court Reverses Judgment for 2 Defendants, Affirms for Another

BOSTON -- The Massachusetts Supreme Court has reversed an award of summary judgment to two asbestos defendants, finding that the plaintiff had in fact established exposure to the companies' asbestos-containing products. Morin, et al., v. Autozone Northeast Inc., et al., No. 09-P-1816 (Mass. Sup. Jud. Ct.).

However, the high court did affirm judgment entered in favor of a third defendant in the March 14 opinion, concluding that the plaintiff's claims against that company involved too many "layers of speculation."

The claims were asserted by Kathleen Morin on behalf of her mother, Geraldina Medeiros, who allegedly was exposed to asbestos-containing products …
