N.C. Appellate Court Affirms Workers' Compensation Benefits in Asbestosis Case

RALEIGH, N.C. -- A North Carolina appellate court has affirmed an award of workers' compensation to an employee of FMC Corp. who claimed that he was exposed to asbestos-containing insulation while employed by the company. Ensley v. FMC Corp., et al., No. COA10-522 (N.C. Ct. App.).
In the March 15 opinion, the Court of Appeals of North Carolina did reverse the award of attorneys' fees to the plaintiff, ruling that there was no evidence that FMC had asserted the appeal on unreasonable grounds.
