NEW ORLEANS -- A Louisiana appellate court has reversed a summary judgment award in favor of Hopeman Brothers Inc., finding that testimony from the decedent's former co-worker established that the employees of Avondale Shipyard Inc. were more likely than not exposed to the defendant's asbestos-containing wallboard. Lucas, et al. v. Hopeman Brothers Inc., et al., No. 2010-CA-1037 (La. Ct. App., 4th Cir.).
However, in the same Feb. 16 opinion, the Louisiana 4th Circuit Court of Appeal did affirm summary judgment entered in favor of Foster Wheeler LLC, CBS Corporation (Westinghouse/CBS) and Reilly-Benton Co. Inc., ruling that the plaintiffs had failed …
