Oregon Appellate Court Reverses Summary Judgment in Favor of Union Carbide

SALEM, Ore. -- The Oregon Court of Appeals has reversed an award of summary judgment to asbestos defendant Union Carbide, finding that there was sufficient evidence to support the plaintiff's contention that he was exposed to the defendant's raw asbestos. Griffin, et al. v. Allis-Chalmers Corp., et al., No. A138278 (Ore. Ct. App.).

In the Jan. 7 opinion, the appellate court rejected Union Carbide's argument that it would take a "quantum leap" in reasoning to connect the plaintiff's exposure with the defendant's product, given that both parties were "regular" visitors to the work site in question.
