PHOENIX -- An Arizona state court has awarded summary judgment to three asbestos defendants who had contended that the plaintiffs' claims were barred under New Mexico's statute of repose. Pounders, et al. v CBS Corp., et al., No. 2008-014007 (Ariz. Super. Ct., Maricopa Cty.).

In the Jan. 10 two-page order, Judge Donald Daughton noted that the court had previously determined that New Mexico law applied to the claims of a former power plant worker.
