LOS ANGELES -- A California appellate court has affirmed a $9.2 million verdict entered against Union Carbide, finding that the trial court's entry of judgment in the amount of more than $7 million against the company was not erroneous. Stewart, et al. v. Union Carbide Corp., et al., No. B216193 (Calif. Ct. App., 2nd App. Dist., Div. 5).
In the Nov. 16 opinion, the California Second District Court of Appeal found that there was sufficient evidence to support the plaintiffs' claims and further that the defendant was not protected under the sophisticated purchaser defense.
