Md. Court Affirms Summary Judgment Award, Cites Lack of Sufficient Evidence

ANNAPOLIS, Md. -- A Maryland appellate court has affirmed an award of summary judgment to defendants in an asbestos case, ruling that the plaintiffs had not presented sufficient evidence establishing that the defendant's asbestos-containing products were in their specific work areas. Reiter v. Pneumo Abex, No. 72 Sept. Term, 2008 (Md. Ct. App.).
In the Nov. 19 opinion, the Maryland Court of Appeals said that although there was evidence indicating asbestos exposure had occurred at the plaintiffs' work areas, there was a lack of evidence proving that the defendants' products were used in the same areas.
