Court Denies Petition for Rehearing of Dispute Involving Grinding Manufacturer

LOS ANGELES –– A California appellate court has denied an asbestos plaintiff’s petition for rehearing, allowing its decision in favor of grinder manufacturer Hennessy Industries Inc. to stand. Barker, et al. v. Hennessy Industries Inc., et al., No. B232316 (Calif. Ct. App., 2nd Dist., Div. 2).
The California Second District Court of Appeal denied the plaintiffs’ petition on June 19, maintaining its finding that under recent precedent, the defendants could not be held liable for a product that did not containing asbestos and could be operated without the use of asbestos-containing materials.
