Court Reverses Entry of Judgment, Says Trial Court Incorrectly Reduced Award

LOS ANGELES -- A California appellate court has reversed a trial court's entry of judgment in an asbestos case, saying that the court's reduction of economic damages erroneously speculated as to how much of the award consisted of future medical expenses. Smith v. Pneumo Abex LLC, et al., No. B217063 (Calif. Ct. App., 2nd Dist., Div. 3).
In the Sept. 17 ruling, the California 2nd District Court of Appeal said that because the parties stipulated to the amount of economic damages during trial, the plaintiffs did not need to prove how that amount would be split after the trial.
