Wash. Court Reverses Summary Judgment Award for Premises Defendant

TACOMA, Wash. -- A Washington appellate court has reversed a summary judgment award entered in favor of a premises defendant, concluding that the defendant was a general contractor and therefore could be held liable for injuries occurring to the employee of a subcontractor and his family members. Arnold, et al. v. Saberhagen Holdings Inc., et al., No. 39055-8-II (Wash. Ct. App., Div. II).

However, the Washington Court of Appeals, Division II, did affirm an award of summary judgment on primary exposure claims in the Aug. 31 opinion, noting the decedent had worn protective suits during the alleged period of exposure. …
