La. Court Reverses Judgment Entered in Favor of Insurance Company

NEW ORLEANS -- A judgment entered in favor of an insurance company has been reversed by a Louisiana appellate court, which ruled that under the law at the time, the claims accrued would permit the survival claims to proceed against the defendant. Marcel, et al. v. Delta Shipbuilding Co., et al., No. 2010-CA-0168 (La. Ct. App., 4th Cir.).
In the Aug. 4 opinion, the Louisiana Court of Appeals for the 4th Circuit said that the trial court had erred when it applied law precluding claims against dissolved companies.
