Maine High Court Affirms Dismissal of Claims Against Dissolved Company

PORTLAND, Maine -- The Maine Supreme Court has rejected the efforts of asbestos plaintiffs to contend that the state's three-year statute of repose involving dissolved corporations conflicted with the state's "open courts" provision. Godbout, et al. v. WLB Holding Inc., No. 09-490 (Maine Sup. Jud. Ct.).

In the May 27 opinion, the high court opined that if the plaintiffs wanted to challenge public policy regarding the statute, "that challenge is better addressed to the Legislature."

The underlying complaint contends that Aubert Godbout was exposed to asbestos-containing products, leading to his development of mesothelioma. The plaintiffs named W.L. Blake & Co. …
