Ohio Court Affirms Administrative Dismissal of Lung Cancer Case

CLEVELAND -- An Ohio appellate court has affirmed the administrative dismissal of a lung cancer asbestos case, ruling that the plaintiffs had failed to demonstrate that asbestos exposure was the substantial contributing factor in the development of the illness. Holston, et al. v. Adience Inc., et al., No. 93616 (Ohio 8th App. Dist. Ct. App., Cuyahoga Cty.).
In support of its June 3 decision, the 8th District Court of Appeals of Ohio for Cuyahoga County pointed to the testimony proffered by the plaintiffs that opined the lung cancer was directly caused by his workplace history and tobacco use.
