Ill. Court Enforces Duty on Employer Defendant in Take-Home Exposure Case

MT. VERNON, Ill. -- An Illinois appellate court has reversed a judgment entered in favor of an employer defendant in a take-home asbestos exposure case, finding that the employer did in fact owe a duty to warn the wife of one of its workers. Simpkins, et al. v. CSX Transportation, et al., No. 5-07-0346 (Ill. App. Ct., 5th Dist.).
In the June 10 opinion, the Illinois Court of Appeals for the 5th District said that the employee's wife's exposure to asbestos brought home on her husband's work clothing was a foreseeable risk.
