SAN FRANCISCO -- A California appellate court has affirmed the dismissal of asbestos claims against Diamond International Corp., which claimed that as a dissolved corporation under Delaware law, it was immune to the lawsuit. Greb, et al. v. Diamond International Corp., No. A125472 (Calif. Ct. App., First App. Dist., Div. 1).
In the April 26 opinion, the California First District Court of Appeal rejected plaintiff efforts to portray the company as a foreign corporation under California law, which would allow the suit to continue.
