LOS ANGELES -- A California appellate court has reversed a judgment entered in favor of two asbestos defendants, ruling that the exclusion of the plaintiffs' product identification witness was erroneous. Teruel-Armstrong, et al. v. Borg-Warn Morsetec Inc., et al., No. B215119 (Calif. 2nd Dist. Ct. App., Div. 3).
In the March 16 order, the 2nd District Court of Appeal vacated the summary judgment orders and remanded the case with instructions to reopen discovery, which will offer the defendants to enforce their discovery rights, obtain appropriate court orders and move for sanctions.
