Pa. and W.Va. Courts Issue CMOs Requiring Disclosure of Bankruptcy Forms

SPRINGFIELD, Pa. -- In recent months, both Pennsylvania and West Virginia trial courts have issued case management orders that require plaintiffs to disclose bankruptcy trust claim details. Thibeault, et al. v. Allis Chalmers Corp., et al., No. 07-27545 (Pa. Ct. Comm. Pls., Montgomery Cty.); In re: Asbestos Personal Injury Litigation, No. 03-C-9600 (W.Va. Cir. Ct., Kanawha Cty.).

In an order dated Feb. 22, the Pennsylvania Court of Common Pleas for Montgomery County stated that each plaintiff is required to file "any and all" Asbestos Bankruptcy Trust claims available.
