SAN FRANCISCO -- A summary judgment award entered in favor of CertainTeed Corp. has been affirmed by a California court, which ruled that there was insufficient evidence in the record that the defendant controlled the packaging, marketing or shipment of an asbestos-containing product. Johnson v. Certainteed Corp., No. A125234 (Calif. 1st Dist. Ct. App., Div. 2).

On Jan. 28, the California First District Court of Appeal found that the relationship between the defendant and the plaintiff was "tenuous," and therefore, the claims failed.
