Court: Deposition Admissible, No Evidence of Abusive Litigation Practices

LOS ANGELES -- A California appellate court has affirmed the denial of a defense motion to exclude an asbestos decedent's deposition testimony, rejecting the defendant's argument that the deposition was obtained using "abusive litigation tactics." Union Carbide Corp. v. The Superior Court of Los Angeles County, et al., No. B216591 (Calif. 2nd Dist. Ct. App., Div. 2).
In the Jan. 15 opinion, the Second District Court of Appeal found no evidence that the plaintiffs' law firm filed a Texas action for an "improper purpose" and concluded that Union Carbide would not prejudiced by the admission of the deposition.
