NEW YORK - A New York appeals court has upheld an award of summary judgment to IBM, Inc. after finding that there was no evidence of any issue of fact as to whether the company exercised control over a work site where a laborer claimed he was exposed to asbestos. Mazzocchi, et al. v. International Business Machines, Inc., et al., No. 1010, 1011 (N.Y. Sup. Ct., App. Div.).
