Court Rejects Efforts to Require Quantification in Causation Standard

SAN FRANCISCO -- A California appellate court has rejected defense efforts to have the court consider dose quantification in determining whether a plaintiff established causation in an asbestos case, affirming a $20 million verdict. Mahoney v. Georgia-Pacific LLC, No. A122038 (Calif. 1st Dist. Ct. App., Div. 1).
In its Oct. 30 opinion, the First District Court of Appeal also found that the jury award was not excessive, opining that "the verdict was [not] the result of any misconduct or of passion or prejudice of the jury."
