Court Dismisses Final Count Against Law Firm, Dr. Harron in Fraud Case

WHEELING, W.Va. -- The final fraud and conspiracy claims pending against an asbestos plaintiff firm and Ray Harron, M.D., have been dismissed after a federal court found that the plaintiff could not prove it relied on the alleged fraudulent acts. CSX Transportation Inc. v. Gilkison, et al., No. 05-00202 (N.D. W.Va.).

In the Sept. 15 opinion, the U.S. District Court for the Northern District of West Virginia also said plaintiff CSX Transportation failed to establish that the defendants acted with fraudulent intent, and the claims, therefore, failed.
