COLUMBUS, Ohio -- An amici group has filed a brief asking Ohio's highest court to uphold a decision that declined to impose liability on a premises defendant for secondhand asbestos exposure. Boley, et al., v. Goodyear Tire & Rubber Co., et al., No. 2009-0542 (Ohio Sup. Ct.).
In the Sept. 18 brief filed in the Ohio Supreme Court, the group claims that imposing such liability would intensify asbestos filings in Ohio and impose a new duty rule.
