Court Reverses Verdict, Says Jury Verdict 'Hopelessly Inconsistent'

SAN FRANCISCO -- A California appellate court has reversed and remanded an asbestos case, finding that the jury's decision to find for the defendant on one failure-to-warn theory of liability and for the plaintiff on another was "inconsistent." Oxford, et al. v. Foster Wheeler LLC, No. A121577 (Calif. Ct. App., 1st Dist., Div. 1).

In the Sept. 9 decision, the First District of the California Court of Appeal found that there was no explanation as to how the jury found against the defendant on negligent failure to warn claims, but determined that the product's warnings were not defective.
