Jury Finds No Evidence that Plaintiff Firm Defrauded Asbestos Defendant

WHEELING, W.Va. -- Jurors in West Virginia asked to determine whether a plaintiff law firm defrauded an asbestos defendant by taking part in filing false claims have found for the defendants after a four-day trial. CSX Transportation Inc. v. Gilkison, et al., No. 05-00202 (N.D. W.Va.).

On Aug. 14 the U.S. District Court for the Northern District of West Virginia jury found for Robert Gilkison of Peirce, Raimond & Coulter, rejecting CSX Transportation's allegations that Gilkison didn't relay the plans of two CSX employees to defraud the company.

Judge Fredrick Stamp presided over the trial.
