Ohio Court Upholds Defense Verdict, Finds Testimony Admissible

CLEVELAND -- An Ohio Appellate court has upheld an asbestos defense verdict, ruling that a defense expert did not have to replicate the decedent's exact working condition when testifying as to fiber release. Werts, et al. v. Goodyear Tire and Rubber Co., et al., No. 91403 (Ohio 8th Dist. Ct. App., Cuyahoga Cty.).

In the June 4 ruling, the Eighth District Court of Appeals of Cuyahoga County also found that the trial court was correct in allowing the same expert to rely on unpublished studies.
