Jury Finds for Premises Defendant in California Action

OAKLAND, Calif. -- A California jury has found for a premises defendant in a mesothelioma action, concluding that the company did not know, or should not have known, about the potential risk of using asbestos at its facility. Gersten, et al. v. Asbestos Corporation Ltd., et al., No. RG08402343 (Calif. Super. Ct., Alameda Cty.).

On April 16, the California Superior Court for Alameda County jury rejected the plaintiffs' claims that the defendant was negligent in its supervision of the plant, at which the plaintiff worked as a field engineer for a two-month period.
