La. Appellate Court Reverses Summary Judgment Award in Asbestos Case

NEW ORLEANS -- The Louisiana Fourth Circuit Court of Appeal has reversed an award of summary judgment to three asbestos defendants, opining that the trial court's determination that the plaintiff failed to place the defendant's products at his workplace was erroneous. McAskill v. American Marine Holding Co., et al., No. 2007-CA-1445 (La. 4th Cir. Ct. App.).

In the March 4 opinion, the court said that the evidence presented by the plaintiff is sufficient to permit a finding that the defendants' products were a factor in the plaintiff's development of mesothelioma.
