LIMA, Ohio - Issues of fact exist as to whether a brake manufacturer instructed employees to work with brake products despite possessing knowledge of potential dangers associated with asbestos exposure, an Ohio appellate court has ruled in reversing an award of summary judgment for the defendant. Polanco v. Asbestos Corp. Ltd., et al., No. 11-07-13 (Ohio App., 3rd Dist.).
In a Jan. 12 order, the Ohio Court of Appeals, 2nd District, overturned a trial court's award of summary judgment to the defendants.
