Pa. Court Finds Application of Causation Standard 'Overly Restrictive'

PHILADELPHIA -- A Pennsylvania appellate court has reversed a summary judgment award entered in favor of a dryer felt manufacturer, determining that the trial court was "overly restrictive" in finding that the plaintiff failed to satisfy the state's frequency, regularity and proximity test. Wright, et al. v. Alllied Signal Inc., et al., No. 2805 EDA 2007 (Pa. Super. Ct.).
In the Dec. 19 opinion, the Pennsylvania Superior Court held that a jury could reasonably conclude that the decedent's mesothelioma was caused by exposure to asbestos fibers in the dryer felts based on the evidence proffered by the plaintiff.
