3rd Circuit Affirms Dismissal of Claims, Agrees that Asbestos Plaintiffs Had to Submit ‘Detailed’ Exposure History

PHILADELPHIA –– The U.S. Court of Appeals for the 3rd Circuit has upheld a decision dismissing the asbestos claims of 12 plaintiffs, ruling that MDL Judge Eduardo C. Robreno did not abuse his discretion when he found the claims did not meet pleading requirements.

In the May 31 order, the appellate court agreed with the MDL court’s interpretation that Administrative Order No. 12 required plaintiffs to submit a complete occupational and environmental history.

The underlying cases were dismissed by Asbestos Products Liability Multidistrict Litigation Judge Eduardo C. Robreno after he found that the 12 plaintiffs had not included specific histories …
