N.J. Court Remands Asbestos Action, Finds Raytheon’s Removal Untimely

CAMDEN, N.J. –– A New Jersey federal court has remanded an asbestos action, after finding that Raytheon (NYSE:RTN) was put on notice of the removability of the claims when the plaintiffs filed their first amended complaint.

In the May 16 opinion, the U.S. District Court for the District of New Jersey concluded that since the defendant did not supply other products to the U.S. Air Force that would not have been subject to federal defenses, the plaintiffs mention of the defendants “communications equipment,” was sufficient to put Raytheon on notice that federal jurisdiction could be available.
