Huntsman Urges Remand Of $45 Million Coverage Battle

HOUSTON - An insured is urging a Texas federal judge to remand a $45 million coverage dispute to state court, arguing that the third-party reinsurer defendants have waived their right of removal. Huntsman Corp. v. International Risk Insurance Co. v. ACE American Insurance Co., No. 4:08-cv-01542 (S.D. Texas).

The case was removed from the Jefferson County District Court and is before Judge Lee H. Rosenthal of the U.S. District Court for the Southern District of Texas. In a June 16 brief, Huntsman argues that the reinsurers waived their right of removal.
