NEW YORK - AIU Insurance Co. is urging a New York federal magistrate judge to compel a reinsurer to disclose commutation information in a $12.3 million lawsuit over reinsurance coverage for AIU's settlement with Foster Wheeler Co. AIU Insurance Co. v. TIG Insurance Co., No. 07-CIV-7052 (S.D. N.Y.).
The reinsurer, TIG Insurance Co., opposed the motion on May 20, arguing that AIU did not fulfill the meet-and-confer requirements pursuant to Rule 37 of the Federal Rules of Civil Procedure and therefore its motion to compel should be denied.
