Lamisil's Liver Toxicity Warnings Were Adequate, Fifth Circuit Rules

NEW ORLEANS - A federal appeals court has upheld an award of summary judgment to the makers of a drug used to treat toenail fungus, finding that warnings provided by the manufacturer were sufficient to alert users of possible liver toxicity associated with the drug. Stahl v. Novartis Pharmaceuticals Corp., 00-31440 (5th Cir.).

In its Feb. 13 decision, the Fifth Circuit U.S. Court of Appeals said plaintiff Joseph Stahl failed to show that the Eastern District of Louisiana erroneously disposed of claims against Novartis Pharmaceuticals Corp. for its alleged failure to affix adequate warnings to its Lamisil product.
