U.K. Court of Appeal Orders Disclosure Of Arbitration Documents

LONDON - In a battle between legal services providers being waged in several jurisdictions, the interests of justice require disclosure of arbitration documents in foreign court proceedings, an English Court of Appeal panel has unanimously affirmed. Emmott v. Michael Wilson & Partners Ltd., No. 2007 Folio 1521 (Eng. App.).
The panel ruled that although the documents are confidential in principle, the interests of justice require it to ensure that parties to London arbitrations "should not seek to use the cloak of confidentiality with a view to misleading or potentially misleading foreign courts."
