Pa. Trial Court Finds Plaintiff's Propulsid Claims Insufficient

PHILADELPHIA - A trial court has found that a plaintiff's breach of express warranty and unfair trade practices claims against Johnson & Johnson and Janssen Phamaceutica for injuries associated with the drug Propulsid are legally insufficient, sustaining the drug companies' objections to plaintiff's second amended complaint. Boyd v. Johnson & Johnson, et al., No. 965, January Term, 2001 (Pa. Comm. Pls. Ct., Philadelphia Cty.).

The Philadelphia County Court of Common Pleas concluded Jan. 22 that, because the complaint was unclear as to whether plaintiff had seen or heard any misrepresentation of Propulsid, the claims were insufficient.
