California Court Denies Class Certification to Rezulin Plaintiffs

LOS ANGELES - A California state court has denied class certification to a class of plaintiffs who alleged that Rezulin manufacturer Warner-Lambert Co. deceived consumers through false and misleading advertising. Delaney, et al. v. Warner-Lambert Co., et al., No. BC227414 (Calif. Super. Ct., Los Angeles Cty.).
The Los Angeles County Superior Court concluded in its Jan. 15 decision that common questions of law did not predominate and, furthermore, there was no evidence that plaintiffs sustained damage as a result of defendants' alleged deception.
